Travel Buddy Card – Universal Wallet Terms & Conditions

These Universal Wallet Terms and Conditions (the “Wallet Terms”) are an agreement between you and BFC Payments B.S.C. (Closed) (hereinafter called “BFCP” or “We” or “Us”) that governs your access to and use of Apple Pay® (a service offered by Apple®) and Samsung Wallet (a service offered by Samsung Gulf Electronics FZE), (hereinafter each called a “Wallet” and together the “Wallets”) on your Travel Buddy Card including any supplementary cards issued by BFCP and they supplement the applicable terms and conditions between you and us in connection with each Card Account wallet to which the Travel Buddy Card is linked available on our website (the “General T&Cs”). Your enrolment into the Wallets does not impact any other agreement we may have with you and Credit and Debits made to your Card Account wallet, whether made using a Wallet or your physical card, which will continue to be governed by the General T&Cs.

By choosing to add or use the Travel Buddy Card in or through the Wallets, you agree to use your Travel Buddy Card through the Wallets in accordance with these Wallet Terms. If you do not agree to these Wallet Terms, then you must not add your Card to, or use your Card in connection with the Wallets. Use of the Wallets is at your discretion. You are not obliged to use the Wallets in connection with your Travel Buddy Card. We, in our sole and absolute discretion, shall determine which Travel Buddy Cards will be eligible for use through the Wallets.

Unless otherwise defined or the context requires otherwise, any terms not defined herein shall have the same meaning prescribed to them in the General T&Cs. In case of any inconsistency between General T&Cs and these Wallet Terms, the latter shall prevail.

The term Apple Pay® shall include the Apple Pay® branded payment functionality, the Card provisioning functionality, the transaction history displayed by the Apple Pay® Wallet application, the Apple Watch® application, Apple Pay® on the Web, the Apple Watch®, and any other Eligible Device (as defined below). The term, Samsung Wallet, shall include the Samsung Wallet branded payment functionality, the Card provisioning functionality, and transaction history displayed.

You acknowledge that your use of Apple Pay® and/or Samsung Wallet to purchase goods and services with your Travel Buddy Card is further governed by Apple Pay® Terms and Conditions, and any other applicable terms and conditions set forth by Apple®, its affiliates and/or any third party supporting Apple Pay® (jointly ‘®) (the “Apply Pay T&Cs”) and Samsung Wallet is subject to the terms and conditions set forth by Samsung Gulf Electronics FZE and/or its affiliates (jointly ‘Samsung’) (the “Samsung Wallet T&Cs”) with respect to the use of Samsung Wallet as applicable. If you proceed to provision and use the Travel Buddy Card on Apple Pay® and/or Samsung Wallet, you will be deemed to have accepted the Apple® T&Cs and/ or the Samsung Wallet T&Cs respectively.

We may, at our sole and absolute discretion, allow you to provision and use the Travel Buddy Card on the Wallets, which you may have activated from time to time.

Eligibility / Enrollment

Apple Pay® is a service offered exclusively by Apple® and is available to Cardholders with a compatible Apple® device as determined by Apple® (“Apple Pay® Eligible Device”’) for the purposes of purchasing goods and services or for other permitted transactions at merchants that accept Apple Pay® as a form of payment through near field communication (“NFC”) enabled payment terminals, for in-app purchases and for purchases on authorized merchant websites when using a compatible browsers or devices.

Samsung Wallet is available to cardholders for the purposes of purchasing goods and services with a compatible Samsung mobile device that contains a secure element (“Samsung Wallet Eligible Device”), at NFC enabled merchants that accept Samsung Wallet as a form of payment. The Apple Pay® Eligible Device and/or the Samsung Wallet Eligible Device may hereinafter each be referred to as an “Eligible Device” and together the “Eligible Devices”)

Wallets allow you to use your Apple Pay® Eligible Device or Samsung Wallet Eligible Device to access and use your Travel Buddy Card to make purchases in place of presenting or using your physical Travel Buddy Card. To add your Travel Buddy Card to a Wallet, you must register your Travel Buddy Card with the respective Wallet by linking (provisioning) your Travel Buddy Card to an Apple Pay® Eligible Device or Samsung Wallet Eligible Device. You may be required to take additional steps to authenticate yourself before your Card is added to a Wallet, including but not limited to providing additional identification information. When provisioning your Travel Buddy Card through a Wallet to an Apple Pay® Eligible Device or Samsung Wallet Eligible Device that contains a secure element, a unique numerical identifier (“Token”) different from your Travel Buddy Card number will be added to such secure element for the purpose of making purchases through a Wallet.

If your then present Travel Buddy Card is renewed or replaced due to its expiration or where you have requested for a replacement, your Token in a Wallet will be automatically updated with the new Travel Buddy Card information. Accordingly, you agree that your new Token (updated with the new Travel Buddy Card information) can continue to be used to make transactions through a Wallet even without activating your renewed/replaced physical Travel Buddy Card and you will be fully liable for these transactions. This automatic update will not apply in certain circumstances including, but not limited to, when your physical Travel Buddy Card is replaced due to a reported loss, theft, or unauthorised use, where no new cards have been issued and when your Apple Pay® Eligible Device or Samsung Wallet Eligible Device has been reported stolen.

Due to the manner in which a Wallet operates, you may need to present your Apple Pay® Eligible Device or Samsung Wallet Eligible Device at a merchant when you return an item purchased using a Wallet

We may, at our sole and absolute discretion, approve or reject the addition of a Travel Buddy Card to a Wallet and need not give you any reason for our approval or rejection.

Your Use Of Travel Buddy Card Through A Wallet

You must keep your Apple Pay® Eligible Device or Samsung Wallet Eligible Device safe (including ensuring that the device is not modified contrary to the software or hardware guidelines of the manufacturer) and ensure that where your passcode or personal identification number is required to allow you to use your Eligible Device to access and use your Travel Buddy Card to make purchases using a Wallet, your passcode or personal identification number is not disclosed to any one and you must take all precautionary steps and prevent any fraud, loss or theft in respect of your Apple Pay® Eligible Device or Samsung Wallet Eligible Device or any Travel Buddy Card. You are solely responsible for the selection, maintenance, security, and operation of your Apple Pay® Eligible Device or Samsung Wallet Eligible Device or your internet service provider. It is your responsibility to delete your Travel Buddy Card from your old device if you upgrade, change, or dispose of it and then re-register your Travel Buddy Card to your new Apple Pay® Eligible Device or Samsung Wallet Eligible Device.

If you enroll/opt for biometric verification/authentication such as fingerprint identity (Touch ID), Face ID, personal identification number or passcode on Apple Pay® or Samsung Wallet, the collection, storage, enrolment, and access to Apple Pay® and/or Samsung Wallet using your biometric information, personal identification number or passcode will be made using the technology on your Apple Pay® Eligible Device or Samsung Wallet Eligible Device. Accordingly, when you log into a Wallet and choose to be verified using the technology on your Apple Pay® Eligible Device or Samsung Wallet Eligible Device, your fingerprint or any other biometric information, personal identification number or passcode will be matched and verified against your Apple Pay® Eligible Device or Samsung Wallet Eligible Device’s technology. Accordingly, you acknowledge that BFCP has no control over the technology on your Apple Pay® Eligible Device or Samsung Wallet Eligible Device, the availability, capability, verification method, security and integrity of your Apple Pay® Eligible Device or Samsung Wallet Eligible Device and cannot be held liable for transactions effected using Apple Pay® and / or Samsung Wallet and authorised using any biometric information or personal identification number or passcode. You should therefore assess if your Apple Pay® Eligible Device or Samsung Wallet Eligible Device’s manner of verification/authentication and risks associated with such use is acceptable to you.

Where you have enrolled/opted for biometric verification/authentication as detailed above, you are responsible to ensure that only your biometric data is stored in your Apple Pay® Eligible Device or Samsung Wallet Eligible Device. Accordingly, you must not save a third party’s biometrics such as finger print or any other biometric information on your Eligible Device. You agree not to activate the biometric verification/authentication function and to immediately de-activate such biometric verification/authentication function in the event a third party’s biometrics is saved on your Apple Pay® Eligible Device or Samsung Wallet Eligible Device, whether now or in the future. In the event a third party’s biometric data is saved and activated on your Apple Pay® Eligible Device or Samsung Wallet Eligible Device and you continue to use your Apple Pay® Eligible Device or Samsung Wallet Eligible Device to access and use your Travel Buddy Card through a Wallet using the biometric/verification authentication method despite the caution above, you understand that such third party, using his or her biometric data, will be able to use your Apple Pay® Eligible Device or Samsung Wallet Eligible Device to access and use your Card to make purchases or perform transactions with a Wallet. You agree that any such purchases or transactions with a Wallet using your Travel Buddy Card by such third party will be considered as authorised by you and you shall be responsible and liable for these purchases.

Use of a Wallet is at your discretion. You are not obliged to use a Wallet in connection with any Travel Buddy Cards. Accordingly, you agree that the access and use of your Travel Buddy Card on a Wallet will be considered as authorized by you and you shall be responsible and liable for the same. If your Apple Pay® Eligible Device or Samsung Wallet Eligible Device is lost or stolen, any biometric information or personal identification number or other passcode is compromised or unauthorisedly used or Travel Buddy Card has been used through a Wallet without your permission, you must notify BFCP immediately and if we so require, furnish to us a statutory declaration in such form as we specify and/or a police report and/or any other information as BFCP may reasonably require. You are liable for all unauthorised use of your Card in connection with a Wallet. Notwithstanding the foregoing, you are liable for all unauthorised transactions on your Card in connection with a Wallet prior to you notifying us, unless (i) you have fully complied with the safety precautions and you notified us without delay, (ii) you assist in the investigations and recovery, and (iii) we are satisfied that such unauthorised transactions are not due to your misconduct and/or negligence and/or that you have not acted fraudulently.

You agree and acknowledge that the transaction history displayed in a Wallet in connection with use of your Travel Buddy Card in a Wallet solely represents our authorisation of your Apple Pay® or Samsung Wallet transaction using that particular Apple Pay® Eligible Device or Samsung Wallet Eligible Device and does not reflect any post-authorisation activity including but not limited to clearing, settlement, foreign currency exchange, reversals, returns or chargebacks. Accordingly, the purchase amount, currency, and other details for your Wallet transaction history in connection with use of your Travel Buddy Card in a Wallet may not match the transaction amount that is ultimately cleared, settled, and posted to your Travel Buddy Card Statement. You will remain liable to us for the amounts set out on your Travel Buddy Card Statement.

We currently do not impose a fee for using your Travel Buddy Card through Apple Pay® or Samsung Wallet but we reserve the right to impose a fee in the future, and notified to you as appropriate. Please note that Apple®or Samsung or another third-party supporting Apple Pay® or Samsung Wallet may charge a fee for using your Travel Buddy Card in Apple Pay® or Samsung Wallet. Similarly, your telecommunications carrier or provider may impose web-enablement, data usage or text messaging fees or other charges for your use of Apple Pay® or Samsung Wallet.

As a condition to using your Travel Buddy Card in connection with a Wallet, you acknowledge and consent to us sending notifications to the Apple Pay® Eligible Device or Samsung Wallet Eligible Device which may or may not be the same device as your mobile phone number on record with us. If at any time you revoke this consent, we may suspend or cancel your ability to use your Travel Buddy Card through a Wallet

Devices modified contrary to the software or hardware guidelines of a manufacturer, including by disabling hardware or software controls, sometimes referred to as jail breaking are not deemed as Apple Pay® Eligible Device or Samsung Wallet Eligible Device. You acknowledge that the use of a modified device to use your Travel Buddy Card in connection with Apple Pay® is expressly prohibited, constitutes a violation of these Wallet Terms and is grounds for us to deny your access to your Travel Buddy Cards through a Wallet

We have the right to suspend or cancel your ability to use your Travel Buddy Cards through a Wallet at any time and need not give you any prior notice or reason for doing so.

We have the right to impose a limit on the transaction amount charged to your Travel Buddy Card through a Wallet. The limit will be such amount as determined by us and notified to you.

Authorization To Collect And Share Data

You agree that we may collect, transmit, store, process and use technical, location, login or other information and personal data about you and your use of the Travel Buddy Cards through Apple Pay® and/or Samsung Wallet. You may revoke such consent at any time. You acknowledge that (i) Apple® and Samsung, the provider of Apple Pay® and Samsung Wallet technology respectively that support the Travel Buddy Cards in Apple Pay® and Samsung Wallet, as well as its sub-contractors, agents, and affiliates or other third parties supporting Apple Pay® and Samsung Wallet and (ii) the applicable payment network branded on your Card (e.g. MasterCard, Visa, and/or any of their affiliates) as well as sub-contractors, agents, and affiliates of such payment networks, will have access to certain details of your transactions made with merchants via use of your Cards through Apple Pay® and/or Samsung Wallet. You acknowledge that the use and disclosure of any personal information provided by you directly to Apple® and/or Samsung, the applicable payment network branded on your Travel Buddy Card, or other third parties supporting Apple Pay® and Samsung Wallet, will be governed by the privacy policy of such party. We acknowledge that we shall only process your personal data in accordance with applicable data protection laws and regulations.

Merchant Relationships And Disclaimers

Merchants may present to you certain discounts, rebates or other benefits (e.g. free shipping) (“Offers”) in a Wallet. Such Offers are subject to certain terms and conditions and may change at any time without notice to you. We will be liable for any loss or damage as a result of any interaction between you and a merchant with respect to such Offers. Subject to applicable law and your Travel Buddy Card terms and conditions, all matters including delivery of goods and services, returns, and warranties, are solely between you and the applicable merchant. You acknowledge that we do not endorse or warrant the merchants that are accessible through a Wallet or the Offers, including but not limited to merchantability or fitness for any particular purpose of any goods and/or services that they provide. Any dispute that you have in connection with the goods or services purchased using your Travel Buddy Cards through a Wallet should be resolved between you and the applicable merchant.

Changes To Participation In The Apple Pay® And/or Samsung Wallet And Terms And Conditions

Subject to applicable law, at any time BFCP may (i) discontinue Apple Pay® and/or Samsung Wallet or your access to Apple Pay® and/or Samsung Wallet, terminate your use of Cards through Apple Pay® and/or Samsung Wallet, (ii) modify or suspend the type or cap the value of transactions allowed using Cards through Apple Pay® and/or Samsung Wallet, (iii) change the eligibility of a Card for use with Apple Pay® and/or Samsung Wallet and (iv) change the Card authentication process, and/ or (v) terminate add, delete or change any term or condition of your Card terms and conditions or these Terms and Conditions. BFCP will provide you with notice of any such termination or change as required by law. Your continued use of Apple Pay® and/or Samsung Wallet will constitute your acceptance and agreement to any such change.

BFCP may revise these Wallet Terms at any time and your continued use of a Wallet shall constitute your acceptance and agreement to such revisions, as implemented from time to time.

Intellectual Property

All intellectual property rights including all patents, trade secrets, copyrights, trademarks, and moral rights (collectively ‘Intellectual Property Rights’) in Apple Pay® and/or Samsung Wallet (including text, graphics, software, photographs and other images, videos, sound, trademarks and logos) are owned either by Apple®, Samsung, BFCP, our licensors or third parties (as applicable). Nothing in these Terms and Conditions gives you any rights in respect of any intellectual property owned by Apple®, Samsung, BFCP, our licensors or third parties and you acknowledge that you do not acquire any ownership rights by adding your Card to, or using your Card in connection with, Apple Pay® and/or Samsung Wallet.

Disclaimers Of Warranty

Apple Pay®: Apple Pay® is provided by Apple® and other third parties that support Apple Pay® and without a warranty from BFCP. You acknowledge and agree that from time to time, your use of your Card may be delayed, interrupted, or disrupted for an unknown period of time for reasons we cannot control. Neither BFCP nor our affiliates will be liable for any claim arising from or related to the use of your Card through Apple Pay® due to such delay, interruption, disruption, or similar failure.

You acknowledge that BFCP is not party to the terms and conditions for Apple Pay® between you and Apple® or the other third parties supporting Apple Pay® and we do not own and are not responsible for Apple Pay®. We do not provide any warranty for Apple Pay®. We are not responsible for maintenance or other support services for Apple Pay® and shall not be responsible for any other claims, losses, liabilities, damages, costs or expenses with respect to Apple Pay®, including, without limitation, any merchantability or fitness for any particular purpose, third party product liability claims, claims that Apple Pay® fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection or similar legislation, and/or claims with respect to intellectual property rights infringement. Any inquiries or complaints relating to the use of Apple Pay®, including those pertaining to Intellectual Property Rights, must be directed to Apple or the other third parties supporting Apple Pay®.

Samsung Wallet:
Samsung Wallet is provided by Samsung, and without a warranty from us. You acknowledge and agree that from time to time, your use of your Card in connection with Samsung Wallet may be delayed, interrupted, or disrupted for an unknown period of time for reasons we cannot control. Neither we nor our affiliates will be liable for any claim arising from or related to use of your Card through Samsung Wallet due to such delay, interruption, disruption, or similar failure. You acknowledge that we are not party to the terms and conditions for Samsung Wallet between you and Samsung and we do not own and are not responsible for Samsung Wallet. We are not providing any warranty for Samsung Wallet. We are not responsible for maintenance or other support services for Samsung Wallet and shall not be responsible for any other claims, losses, liabilities, damages, costs or expenses with respect to Samsung Wallet, including, without limitation, any merchantability or fitness for any particular purpose, third party product liability claims, claims that Samsung Wallet fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection or similar legislation, and claims with respect to intellectual property infringement. Any inquiries or complaints relating to the use of Samsung Wallet, including those pertaining to Intellectual Property Rights, must be directed to Samsung.

We do not recommend, endorse, or make any representation or warranty of any kind regarding the performance or operation of your Eligible Device. You are responsible for the selection of an Eligible Device and for all issues relating to the operation, performance and costs associated with such Eligible Device.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall BFCP, its processors, suppliers or licensors (nor their respective affiliates, agents, directors, and employees) be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, or other intangible losses, that result from the use of, inability to use, unavailability of Wallets, or your use of your card through Wallets.

To the maximum extent permitted by applicable law, BFCP, our processors, suppliers, and licensors (and their respective affiliates, agents, directors, and employees) assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of Apple Pay® and/or Samsun Wallets, including your use of your Card through Wallets; (iii) any interruption or cessation of transmission to or from Apple Pay® and/or Samsun Wallets; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through Wallets by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through Wallets and/or (vi) user content or the defamatory, offensive, or illegal conduct of any third party. This provision will survive the termination or expiration of these terms and conditions.

INDEMNITY – Apple Pay®

You will indemnify, defend, and hold BFCP (and its employees, directors, agents, affiliates and representatives) harmless from and against any and all claims, costs, losses, damages, judgments, tax assessments, penalties, interest, and expenses (including reasonable attorneys’ fees) arising out of any claim, action, audit, investigation, inquiry, or other proceeding instituted by a person or entity that arises out of or relates to: (a) any actual or alleged breach of your representations, warranties, or obligations set forth in these Wallet Terms, including any violation of any policies of BFCP, Apple®or any related third party service provider; (b) your wrongful or improper use of Apple Pay®, including willful misconduct, negligence or fraud; (c) your violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights; (d) your violation of any law, rule or regulation of the Central Bank of Bahrain or any other applicable country; (e) any access or use of Apple Pay® by any other party with your biometric data (including Touch ID or Face ID) or personal identification number or passcode or other appropriate security code, and (f) any change in law, regulation or official directive which has an effect on the Card or Apple Pay®, and the same may be debited from your Card and/or shall be paid by you on demand. This provision will survive the termination or expiration of these Wallet Terms.

INDEMNITY – Samsung Wallet

You will indemnify, defend, and hold us harmless (and our employees, directors, agents, affiliates and representatives) from and against any and all claims, costs, losses, damages, judgments, tax assessments, penalties, interest, and expenses (including reasonable attorneys’ fees) arising out of any claim, action, audit, investigation, inquiry, or other proceeding instituted by a person or entity that arises out of or relates to: (a) any actual or alleged breach of your representations, warranties, or obligations set forth in these Wallet Terms, including any violation of our policies; (b) your wrongful or improper use of Samsung Wallet, including willful misconduct or fraud; (c) your violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights; (d) your violation of any law, rule or regulation of the Central Bank of Bahrain or any other applicable country; (e) any access or use of Samsung Wallet by any other party with biometrics authentication or personal identification number or passcode or other appropriate security code, and (f) any change in law, regulation or official directive which has an effect on the Card or Samsung Wallet, and the same may be debited from your Card and/or shall be paid by you on demand. This provision will survive the termination or expiration of these Wallet Terms.

Representation And Warranty

You represent and warrant to us that: (i) you and all transactions initiated by you or using any of your Travel Buddy Cards added to a Wallet will comply with all Central Bank of Bahrain rules and regulations applicable to you, including any applicable tax and any anti-money laundering laws and regulations; (ii) you will not use any of your Travel Buddy Cards through a Wallet fraudulently or in any manner so as to interfere with the operation of a Wallet; (iii) you will not permit any use of your Travel Buddy Card(s) through a Wallet by any third party; and (iv) your use of your Travel Buddy Card in connection with a Wallets will comply with these Wallet Terms.

These Wallet Terms are governed by the laws of the Kingdom of Bahrain and you hereby agree to submit to the exclusive jurisdiction of the courts of the Kingdom of Bahrain, in connection herewith.

Terms and conditions of Travel Buddy Card

These terms and conditions (“Terms and Conditions”) govern the issuance and use of BFC Pay Travel Buddy Card and Travel Buddy+ Card

1. Definitions and interpretations

A) DEFINITIONS

Unless otherwise mentioned:

  1. “Account” means a customer account created and maintained in the records of BFCP to reflect Card Transactions and any Service Charges that may be applied.
  2. “Add Money” means adding funds into BHD wallet of Travel Buddy Program
  3. “ATM” means an automatic teller machine, a device that enables cash withdrawals and other financial transactions to be executed electronically.
  4. “BFCP” means BFC Payments B.S.C. (C), a closed joint stock company incorporated in the Kingdom of Bahrain under commercial registration number CR 121852 and licensed by the Central Bank of Bahrain as an Ancillary Service Provider; and having its registered address at Flat No. 303, Building 150, Road 1507, Block 315, P.O. Box 243, Manama, Kingdom of Bahrain.
  5. “BFC Pay Travel Buddy Card” or “Travel Buddy Card” means the prepaid multicurrency reloadable Card which is issued by BFCP.
  6. “Business Day” means the day on which BFCP is open for normal operation and providing its services.
  7. “Card Charges” means any charges payable by a Cardholder in respect of a Card as notified by BFCP from time to time including but not limited to the amount incurred by the Cardholder on all Card Transactions, service charges, issuance, annual subscription, renewal, and replacement fees as set out in the Service Charges Schedule below.
  8. “Card Transaction” or “Transaction” means any transaction, which is done by the Cardholder through the use of the Card in accordance with these Terms and Conditions including any debit or credit transaction reflected in the Account by use of the Card or loading it.
  9. “Cardholder” means the individual to whom the Card is issued by BFCP.
  10. “Cash Deposit Machine” means a Cash Dispensing Machine, a device that enables cash withdrawals and other financial transactions to be executed electronically.
  11. “Chargeback” means the reversal of a Card Transaction which is disputed by the Cardholder
  12. “Merchant Establishment” means any establishment (including stores, shops, restaurants, hotels, airlines, cash advance points, and ATMs/CDMs etc.) wherever located in non-sanctioned jurisdictions, which accepts cards in the VISA network.
  13. “PIN” means the unique Personal Identification Number generated by the Cardholder and validated by BFCP to enable usage of the Card at Point of Sale (POS) Machines ATMs, CDMs, Merchant Establishments, and other self-service facilities.
  14. “Transfer to Wallets” means moving funds from BHD wallet to other currency wallets of Travel Buddy Program or vice-versa.
  15. “Travel Buddy Program” consists of Travel Buddy and Travel Buddy+ cards issuance, distribution, and portfolio management.
  16. “Wallet” means a customer’s account’s wallet of a particular currency created and maintained in the records of BFCP

b) Interpretations:

  1. Clause, Schedule, and paragraph headings shall not affect the interpretation of these Terms and Conditions.
  2. A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality).
  3. The Schedules form part of these Terms and Conditions. Any reference to these Terms and Conditions includes the Schedules.
  4. A reference to a company shall include any company, corporation, or other body corporate, wherever and however incorporated or established.
  5. Unless the context otherwise requires, words in the singular shall include the plural and the plural shall include the singular.
  6. Unless the context otherwise requires, a reference to one gender shall include a reference to the other gender.
  7. These Terms and Conditions shall be binding on and endure to the benefit of the Parties and their respective personal representatives, successors and permitted assigns, and references to any party shall include that party’s personal representatives, successors, and permitted assigns.
  8. A reference to a statute or statutory provision is a reference to it as amended, extended, or re-enacted from time to time.
  9. A reference to writing or written includes fax and email.
  10. Any obligation on a party not to do something includes an obligation not to allow that thing to be done.
  11. References to a document in agreed form are to that document in the form agreed by the parties and initialed by them or on their behalf for identification.
  12. A reference to these Terms and Conditions or to any other agreement or document referred to in these Terms and Conditions is a reference to these Terms and Conditions or such other agreement or document as varied or novated (in each case, other than in breach of the provisions of these Terms and Conditions) from time to time.
  13. References to clauses and Schedules are to the clauses and Schedules of these Terms and Conditions.

2. The Card

2.1 Issuance of a Card

  1. Issuance of a Card is subject to the applicant for a Card providing a duly completed online card application and/or providing any other documents that BFCP may, in its sole and absolute discretion, request in support of such application. The applicant must provide BFCP with updated Identification Documents – such as a national identity card and Passport- upon the expiry of the existing documents. The applicant must also provide BFCP with any other supporting documents as and when required.
  2. There will be two products called Travel Buddy and Travel Buddy+ as a part of this program. Issuing Travel Buddy or Travel Buddy+ to the customers is at BFCP’s sole discretion.
  3. Issuance of the Card is at the sole and absolute discretion of BFCP and BFCP may, refuse to issue a Card to an applicant without assigning any reason for such refusal.
  4. The Cardholder of physical card must sign on the space provided at the back of the Card immediately upon receipt. The Card shall only be valid once the reverse side is signed.

2.2 Loading the Card

  1. Funds can be loaded on the Card via BFC Pay mobile app into BHD wallet through Benefit Pay, Benefit PG etc.
  2. The maximum amount that may be loaded on the Card shall not exceed the amount stipulated by BFCP from time to time and in accordance with directives issued by the Central Bank of Bahrain.

2.3 Transfer to wallets

  1. Funds deposited into BHD wallet can be transferred to any non-BHD active wallet. Similarly, funds can be transferred back to BHD wallet from any non-BHD wallet.
  2. Rate to convert funds from BHD to non-BHD or vice-versa will be displayed on BFC Pay mobile app before the transaction is performed and confirmed by the Cardholder

2.4 Ownership of the Card

The Card shall remain the property of BFCP at all times and the Cardholder shall be obliged to surrender the Card to BFCP on demand.

2.5 Safeguarding the Card and the PIN

The Card is issued to the Cardholder at the Cardholder’s risk and responsibility. The Cardholder must keep the Card and the PIN separately, safe, and secure. The Cardholder should not write the PIN on the Card. If the Card is lost or stolen or suspected stolen or if the PIN has become known or is suspected to have become known to any unauthorized person, the Cardholder must immediately notify BFCP in writing.

3. Using the Card

3.1

The Card is a prepaid card that allows the Cardholder to access funds loaded onto the wallets for the purpose of availing goods, services, facilities, and benefits that are made available by any Merchant Establishment or for cash withdrawals across ATMs/CDMs. The Card is not a credit, or a debit card and the Cardholder will not be entitled to receive any interest on the funds loaded on the card nor will any cheque books be issued to the Cardholder.

3.2

The Card issued is personalized to the Cardholder who shall be responsible for all applicable Card Charges.

3.3

  1. Cardholder can load money into BHD wallet or transfer money to non-BHD wallet or transfer back to BHD wallet subject to the exchange rate displayed on BFC Pay mobile app.
  2. The conducted transaction by the Cardholder will be debited from the subject wallet that is used to complete the transaction subject to the fund’s availability.
  3. If Cardholder conducts transactions from a wallet that has partial funds or no funds available, funds will be debited from any other wallet, provided funds are available, otherwise the transaction will be declined (Maximum total of two wallets will be dipped).
  4. The Cardholder agrees not to use the Card for any illegal Transactions as defined by applicable laws of the Kingdom of Bahrain governing the usage of prepaid cards and as defined by Visa International.
  5. Cardholder agrees not to use the Card for wholesale/ corporate/ business purposes, and the same is strictly to be used for personal/ retail usage.

3.4 Exchange rates and wallet dipping

  1. Exchange rate: For “Transfer to wallet” transactions, BFCP exchange rate will be applied, which will be displayed on the mobile application and consent from Cardholder is taken before transactions is conducted.
  2. For Spend Transactions (POS, Online, Offline or ATM), converting transaction currency amount to the currency of wallet being dipped, the below process will be followed:
    1. If the transaction currency is one of the wallet currencies being offered by Travel Buddy Program, and BHD wallet is being dipped BFCP rate will be applied which will be displayed on the mobile application
    2. For other conversions, VISA defined exchange rate will be applied.
  3. Wallet Dipping: If the Cardholder is making a transaction in a particular currency and that wallet currency balance is not sufficient, the Travel buddy program will invoke wallet dipping as per the wallet priority list. Wallet dipping isn’t applicable to BHD transactions.
  4. Maximum 2 wallets will be dipped in the priority order stated below:
    1. BHD
    2. USD
    3. AED
    4. SAR
    5. EUR
    6. GBP
    7. Omani Riyal
    8. Turkish Lira
    9. Thai Bhat
    10. Georgian Lari
  5. Example 1: Transaction currency is among the wallet currencies being offered by BFCP as a part of Travel Buddy program.
    Transaction Currency: United States Dollars (USD)
    Transaction amount: USD 100
    1. If balance is fully there in USD wallet
      This amount in USD will be deducted from USD wallet balance
    2. If 0 balance is there in USD wallet
      Next wallet with full sufficient balance will be deducted as per the wallet dipping priority list.
    3. If partial balance is there in USD wallet
      Next wallet with remaining full sufficient balance will be deducted as per the wallet dipping priority list. The dipping will happen across 2 wallets i.e., in this scenario, BHD and other wallets will be checked and in priority it’ll be dipped. USD to BHD will take place as per the BFCP rate, but USD to AED will take place as per VISA defined exchange rate.
  6. Example 2: Transaction currency is not among the wallet currencies being offered by BFCP as a part of Travel Buddy program.
    Transaction Currency: Thai Baht (THB)
    Transaction amount: THB 100
    1. If balance is fully there in BHD wallet
      This amount in THB will be converted to BHD as per VISA exchange rates and be deducted from BHD wallet balance
    2. If 0 balance is there in BHD wallet
      Next wallet with full sufficient balance will be deducted as per the wallet dipping priority list.
    3. If partial balance is there in BHD wallet
      Next wallet with full sufficient balance will be deducted as per the wallet dipping priority list. The dipping will happen across 2 wallets i.e., in this scenario, BHD and other wallets will be checked and in priority it’ll be dipped. THB to BHD and THB to “other wallet e.g., USD” conversion will happen as per VISA exchange rates

6. Loss or Theft of the Card

  1. Upon discovery or suspicion of the loss or theft of the Card, the Cardholder should notify BFCP Customer Service Centre immediately. In the event the Cardholder recovers the Card which has been reported as having been lost or stolen, the Cardholder shall hand over the recovered Card/s to BFCP immediately.
  2. On receiving a request from Card member to replace his/her card through BFC Pay mobile app, BFCP may at its sole and absolute discretion issue the Cardholder with a replacement Card, the possession and use of which shall be governed by these Terms and Conditions.
  3. The Cardholder shall be solely responsible for any unauthorized Card Transactions that are done through the use of the Card/PIN prior to the loss or theft of the Card/ PIN being reported to BFCP. In case of reporting a lost, stolen, or damaged Card, the Cardholder must present his/her valid national identity card to BFCP or any other equivalent ID document in form and substance which is satisfactory to BFCP in its sole and absolute discretion.

7. Disputes, Refunds, and chargebacks

  1. BFCP will credit the Cardholder’s wallet with the amount of any refund only upon receipt of a properly issued credit voucher from the Merchant Establishment (POS) or ATM/CDM. Subject to any rights vested in the Cardholder by applicable law, no claim by a Cardholder against a third party may be the subject of a defense or counterclaim against BFCP. The Cardholder acknowledge to accept a credit refund transaction to his/her Card Wallet Account in the applicable transaction currency if they are entitled to a refund or other credit for any reason for goods or services purchased using the Card.
  2. Cardholders can initiate a dispute request to BFCP for reversing or refunding the transactions under specific circumstances of the dispute resolution rules, e.g., unauthorized transactions or the merchant failed to deliver goods/services after one-off pre-payment. However, not all transactions are protected by dispute resolution.
  3. Cardholders can initiate the lodging of dispute complaint/request with the following procedures:
    1. Call BFC Payments Customer Service Center at +973 1771 1775 (From 8 AM to 8 PM every day)
    2. Complete Transaction details with supporting documents to BFC Payments Customer Service Center at customerservice@bfcpayments.com Supporting documents may include the related transaction receipt/ contract and the proof of the merchant’s failure to deliver goods/services (if applicable).
    3. For any transactions that are in doubt, Cardholders should raise the dispute within 30 working days from the transaction date.
    4. If, under the scenario of merchant closure or failure to deliver goods/services, the request deadline varies by different card associations (in general within 75-120 working days). Cardholders should initiate the request and provide adequate and valid supporting documents as soon as possible. BFC Payments reserves the right to accept the dispute request, the decision of BFC payments shall be final and binding.
    5. The processing time will normally be around 60-90 working days upon receiving all documents. The processing time may be longer depending on the complexity. BFC Payments will raise the request for Cardholders against the acquirer. If the request is accepted by the acquirer (Merchant), the amount will be reversed/refunded to Cardholders via the BFC Payments App.
    6. The Cardholder acknowledge to accept a credit refund transaction to his/her Card Wallet Account in the applicable transaction currency if they are entitled to a refund or other credit for any reason for goods or services purchased using the Card.
    7. As a final resort, BFCP can try to request a retrieval of the charge slip from the merchant’s bank as verification. Please note that the merchant retains the discretion as to whether they wish to respond to our request and such a request will take 30 to 60 days (about 2 months). Upon successful retrieval of the charge slip from the merchant’s bank a fee of BHD 3.000 per transaction will be charged to the customer.

9. Authorization to BFCP

By using the Card, the Cardholder authorizes BFCP to:

  1. Deduct the amount loaded on the Card by the amount of the Card Transaction.
  2. Deduct all applicable Card Charges as and when such charges accrue or arise.
  3. Debit the Account with any charges resulting from currency conversions.
  4. Debit the Account with all amounts notwithstanding that such transactions may exceed the amount loaded onto the Card.
  5. Debit the Account with any other liabilities that may be incurred by the Cardholder through the use of the Card; and/or
  6. Set off any liability owed by the Cardholder to BFCP against the amount loaded on the Card.

10. Rights of BFCP

  1. BFCP may amend these Terms and Conditions and/or change the design of the Card and/or vary the method of calculation of the handling charges, additional charges, finance charges, or any other charges relating to the Card including those
  2. Detailed in the Service Charges Schedule at any time and shall notify the Cardholder of the same in the manner BFCP deems appropriate taking into consideration the applicable regulatory disclosure requirements.
  3. BFCP may record any instructions given, or conversations had, by the Cardholder with BFCP for quality assurance and other purposes and such records of instructions given and conversations had shall be conclusive proof and binding for all purposes and may be used as evidence in any proceeding before any court of law, as BFCP may deem fit.

11. Obligations of the Cardholder

The Cardholder agrees and undertakes:

  1. To safeguard the Card and keep it under his/her personal control at all times and not to divulge the PIN to any other person.
  2. To reimburse BFCP with applicable charges that may be debited to the Card in the event that the balance on the Card is insufficient to defray such amounts.
  3. Not to pledge the Card or use the Card as security for any purpose.
  4. To surrender the Card to BFCP without demur in the event that BFCP exercises its right to suspend or cancel the Cardholder’s use of the Card.
  5. That the records of BFCP shall be considered as conclusive and binding evidence in the absence of manifest error.
  6. To provide any document reasonably requested by BFCP which is necessary for the provision of the services by BFCP hereunder; and
  7. To immediately notify BFCP in writing of any change to the Cardholder’s personal details that have been provided to BFCP in the Application Form.

12. Disclaimer of Liability

In no circumstances shall BFCP be liable for any loss or damage sustained or incurred by the Cardholder, whether direct or indirect, including loss or damage sustained as a consequence of:

  1. BFC or a Merchant Establishment or any ATM or any CDM refusing to allow a Card Transaction or refusing to accept the Card or the PIN; or
  2. Any defect or deficiency in the goods or services supplied to the Cardholder by any Merchant Establishment, or, where applicable, for any breach or non-performance by a Merchant Establishment; or
  3. The Cardholder being unable to withdraw money or avail of Card services either by reason of insufficiency of funds in an ATM/CDM or as a result of an electronic, mechanical, communications failure or otherwise.

13. Personal Information

  1. The Cardholder’s personal information may be stored and processed by computerized or other means by BFCP or any third-party entity to which the data processing aspect of the Card program is outsourced.
  2. The Cardholder is hereby made aware that any personal data that is provided to BFCP including details of purchases and redemptions may be disclosed and shared by BFCP with the authorities as required by law, its affiliates, business partners and other relevant entities as deemed necessary. The Cardholder can withdraw the consent to use or disclose personal information at any time.
  3. The Cardholder irrevocably authorizes and permits BFCP to disclose and furnish such information that it deems fit in relation to the Cardholder or the Cardholder’s card account and its affairs including but not limited to this Agreement to BFCP’s associates, branches, assignees, agents or other parties.
  4. BFCP and any sub-processor shall only store and process the Cardholder’s personal data in accordance with applicable Personal Data Protection laws.

14. Death of the Cardholder

BFCP must be informed in writing on the death, incapacity, dissolution, insolvency, or bankruptcy of the Cardholder and BFCP shall not be held liable for any loss or damage whether direct, indirect, or consequential which may arise from any Card Transactions that are affected prior to written notice having been received by BFCP of such death or insolvency.

Upon receiving notice of the Cardholder’s death or insolvency, BFCP shall suspend the operation of the Account until such time as it is satisfied that a duly appointed successor or court-appointed officer has been legally empowered to operate with the Account or that the heirs of the deceased Cardholder have established their rights to the estate of the deceased Cardholder in accordance with Applicable Law.

15. Termination

  1. The Cardholder may terminate the Card by written notice to BFCP, but such termination shall only be effective on the return to and receipt of the issued card by BFCP and upon settlement of all outstanding liabilities of the Cardholder in full.
  2. The whole of the outstanding balance/charges on the Account (if any) will become immediately due and payable in full to BFCP on termination of the Card or on the Cardholder’s bankruptcy or death.
  3. The Cardholder will be responsible for settling any outstanding amounts on the Account and shall keep BFCP indemnified against all costs, charges (including legal fees), and expenses incurred in recovering such outstanding.
  4. In the event that there is a balance outstanding in favor of the Cardholder on termination, after deducting all amounts that are payable by the Cardholder whether by way of Card Charges or otherwise, BFCP shall pay such balance to the Cardholder.
  5. BFCP may terminate the Card at any time by cancelling or refusing to renew the Card with or without prior notice at its own discretion without any commitment to provide an explanation.

16. Indemnity

The Cardholder undertakes and agrees to indemnify BFCP against any loss, damages, liability, costs and expenses whether legal or otherwise which BFCP may incur by reason of these Terms and Conditions or by any breach thereof or the enforcement of the Bank’s rights as herein provided. All costs expenses in such regard may be debited to the Card account and shall be payable by the Cardholder.

17. Severability

No forbearance, delay, or indulgence by BFCP in enforcing these Terms and Conditions shall prejudice or restrict the rights of BFCP nor shall any waiver of its rights operate as a waiver of any subsequent breach.

18. Waiver of Remedies

These Terms and Conditions shall be construed in accordance with and governed by the Laws of the Kingdom of Bahrain. The courts of the Kingdom of Bahrain shall have exclusive jurisdiction in connection herewith.

19. Governing Law & Jurisdiction

These Terms and Conditions shall be construed in accordance with and governed by the Laws of the Kingdom of Bahrain. The courts of the Kingdom of Bahrain shall have exclusive jurisdiction in connection herewith.

20. Language

These Terms and Conditions have been prepared in English and have been translated into Arabic, in the event of any contradiction between the English and the Arabic texts of these Terms and Conditions, the English text shall prevail.

21. General

  1. The Cardholder hereby irrevocably and unconditionally and without any right to protest, authorizes BFCP to reverse any entry on the Account found to be made in error or omission.
  2. BFCP has certain responsibilities under Anti-Money Laundering Law and other standards to verify the identity and Residence address of Cardholders, and BFCP may request relevant documents as per BFCP’s KYC policy to establish the correctness of these details.
  3. BFCP may amend these Terms and Conditions from time to time and notify the Cardholder (within 30 working days written notice) by such means as deemed fair. No amendments will affect any outstanding order or transaction or any legal rights or obligations which may already have arisen. Notices and other correspondence shall be deemed to be received within seven Business Days after posting, if sent by post.
  4. Notices required to be provided by BFCP to the Cardholder will be in writing addressed to the Cardholder’s last known address and delivered by post, by hand, by courier, or transmission if sent by e-mail. The Cardholder must update BFCP immediately of any change to the Cardholder’s address and /or contact details. Notices required to be given to BFCP by Cardholder hereunder must be made in writing unless otherwise specified in these Terms and Conditions.
  5. The Cardholder agrees and undertakes to keep BFCP indemnified and held harmless against all actions, claims, costs, expenses, and damages brought against or suffered by BFCP arising from a breach by the Cardholder of these Terms and Conditions.

22. Taxes

  1. Any prices, amounts, fees, charges, or other amounts which are payable hereunder are exclusive of any applicable VAT (Value Added Tax).
  2. Where any supplies made hereunder are subject to VAT, BFCP agrees to issue a valid Tax Invoice to the recipient.
