If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). In this case, we may have to cancel a service you have with us but we will notify you if this is the case at the time.

We engage, retain or might, as per requirement and business needs of the Company, employ, engage, contract with third party service professionals/providers to work on behalf of or with Us, under agreements containing confidentiality obligations and in accordance with law, in relation to the services provided by Us on the Platform. Third parties or publicly available sources: We will receive personal data about you from various third parties and public sources as set out below:

  • Identity, Contact, Profile, Financial, and Sensitive Personal Data from corporations we work with to provide mobile wallets, salary wallets, and prepaid cards to their employees or process their salaries through WPS Program.
  • Identity, Contact, Profile, Financial, Transactional, and Sensitive Personal Data from subsidiaries of BFC Group in order to comply with KYC and regulatory checks.
  • Identity and Contact Data received from Central Bank of Bahrain or other Authorities to follow-up on complaints raised by customers.
  • Identity, Contact, and Profile Data from recruitment agencies referring potential candidates.

How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal obligation.

      • Banks, financial services companies, and payment companies involved in processing payments and transactions made by you using our services.
      • Card processing and scheme providers who provide the prepaid / debit cards for you to use, including support for these products.
    • Government and regulatory bodies:
      • The Central Bank of Bahrain (CBB), BENEFIT, Financial Intelligence Directorate (FID), and other governmental bodies and departments where required by law or an instruction of theirs, including compliance with applicable regulations.
      • The Police or the courts in the event that we wish to take legal action.
    • Communications providers:
      • Marketing agencies, social media platforms, and communications firms who operate our website and social media channels on our behalf.
      • Telecommunications firms who we use to contact you about your accounts and products and services you hold with us.
      • Telecommunications firms who may send direct marketing messages to you on our behalf.
    • Technology providers:
      • Third-party companies providing us with IT systems, application, or IT support to maintain our systems.
    • Ancillary service providers:
      • Storage companies for archiving and destruction of your personal data once we have no need to retain it following the delivery of products and services to you.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

International Transfers & Card Networks

Many of our external third parties are based outside the EEA and/or Bahrain so their processing of your personal data will involve a transfer of data outside the EEA and/or Bahrain.

Whenever we transfer your personal data out of the EEA and/or Bahrain, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

How we protect your personal data

We treat the security of all data held by BFC Payments with the utmost importance, and that includes your personal data.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How long we retain your personal data

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. No fee is usually required.

Our lawful bases

Data protection laws applicable to BFC Payments set out a number of requirements for legitimate processing of your personal data, these are often known as lawful bases for processing. These lawful bases are:

  • Contractual obligation – processing of personal data in order to implement a contract to which you are a party or, upon your request, to conclude a contract;
  • Legal requirement – processing of personal data to implement an obligation prescribed by the Law or implementation of a court order from a competent Court or the Public Prosecution;
